eger got back to me in a ticket saying the code change has resolved the issue.

The problem is down to a quirk in the PHP function

PHP Code:

  array_multisort();

and (according to IonCube support) a quirk with their PHP 5 compatability.

We have modified the code to work around the issue. Anyone facing the "Cannot pass parameter 2 by reference" error, please download the latest CVS build and extract from it functions_cron.php. Replace your existing copy with this new one.

Suggests to me otherwise, especially when we do not observe the problem when using ioncube_encoder instead of ioncube_encoder5, or when using unencoded versions of the file. However, the cases are limited to only some web server systems and we're yet to identify the common denominator.
