eger got back to me in a ticket saying the code change has resolved the issue.

The problem is down to a quirk in the PHP function
PHP Code:
array_multisort(); 
and (according to IonCube support) a quirk with their PHP 5 compatability.

We have modified the code to work around the issue. Anyone facing the "Cannot pass parameter 2 by reference" error, please download the latest CVS build and extract from it functions_cron.php. Replace your existing copy with this new one.
